The Process of File a Complaint Against a New Hampshire Insurance Commissioner

The New Hampshire Insurance Commissioner, John Di Lemme, has been in his role for six years. During Egg Insurance has made New Hampshire one of the best states in the country when it comes to insuring residents. With more than eighty-five percent of the population in the state of New Hampshire, it is no surprise that the insurance commissioner is one of the most well-respected individuals in the business. He represents not only New Hampshire, but all of the states that border New Hampshire.

This position is up for a four-year term, which will automatically be renewed upon completion of the current term. The New Hampshire Insurance Commissioner works as an independent commissioner, which means he does not represent any particular insurance company or insurance provider. Each year he receives a percentage of the commission that each company pays him. The amount is set by the Insurance Code and every member of the commission is required to receive a portion of that money. In addition, every member of the commission is also responsible for maintaining the insurance commissioner's budget.

Most New Hampshire residents have no idea who the New Hampshire Insurance Commissioner is, or why they are there. The majority of people simply know that he is responsible for the proper functioning of the New Hampshire insurance industry. The New Hampshire Department of Insurance regulates all of the insurance companies in the state of New Hampshire. This is done through a multi-layered and complicated system known as the Multi-Laying Standards for Insurance. Because of this many people do not understand what goes on behind the scenes.

The New Hampshire Insurance Commissioner performs an investigation into all complaints that are filed within the state of New Hampshire. After finding a complaint that merits further investigation by the New Hampshire Insurance Commissioner then makes his recommendation to the Insurance Company about the validity of the complaint and what steps will be taken to correct it. Then it is up to the company to either accept the recommendation or deny the complaint. If the company denies the complaint then the commissioner has the authority to fine the insurance company. This can include taking away their license to sell policies in New Hampshire.

The New Hampshire Insurance Commissioner has the power to make a recommendation to the state attorney general. If the recommendation is denied by the attorney general then, the commissioner has the power to make his own recommendation to the next attorney general. This is not a requirement for all complaints but if the next recommendation is also denied then the commissioner has the power to make his own recommendation. However, since most complaints end up being approved the process becomes relatively simple.

Once the complaint has been filed with the New Hampshire Insurance Division the complaint is assigned to an insurance agent. Once that agent sees that the complaint has merit they will forward the complaint along with all of the applicable documents to the company in question. At this point the complaint should be provided with an offer to purchase the policy. Once an offer is received, the agent will take the time necessary to review the policy. Once that review is complete the agent will forward it to the insurance provider.

Once the paperwork has been reviewed and the decision has been made, the insurance company will need to respond. They will do so by either accepting or denying the offer. It is at this point where the negotiations will begin. If the company chooses to accept the deal then they will have to pay all the money that was paid out, however if they choose to deny the offer then they will not have to pay anything.

If the complaint ends up being denied the New Hampshire Insurance Division has the authority to perform an investigation. They have a duty to investigate the matter further. Once the investigation has concluded and all evidence is gathered the Division will make its final decision. If the decision is denied, the insurance company has the option to appeal the decision to the Insurance Appeals Division. Once the appeal is completed the case will be back at the Commission for further consideration.
